DOE Seizure Disorder Training Requirements

Background: House Enrolled Act 1089 has two sections which contain requirements regarding the care of students with seizure disorders. The Indiana Department of Education (IDOE) is working with various partners to develop guidance materials and resources to assist schools with implementing these new requirements.

Guidance: The requirements per HEA 1089, which both become effective July 1, 2020, include the following:

1) Each school corporation and charter school shall require all employees who have direct, ongoing contact with children to attend training concerning recognition of the signs and symptoms of seizures and the appropriate steps to be taken to respond to these symptoms: ● This training will be required upon employment and at least once every five years. ● The format for the training may include: in-person presentations, electronic self-review modules, individual study materials, or other methods approved by the governing body or organizer of a charter school that is consistent with current professional development standards and the training programs and guidelines developed by the Epilepsy Foundation of America or a successor organization.

2) If a school corporation or charter school receives a seizure management plan for a student that was developed by the student’s health care provider, the following requirements must be met: ● The school corporation or charter school shall maintain the seizure management and treatment plan on file at the school. ● The school nurse shall develop an individual health plan for the student that applies to the student during the school day or while the student is participating in school-sponsored activities.
A school nurse, or the school nurse’s designee, shall be available to perform the tasks necessary to implement the student’s individual health plan during the school day or while the student is participating in school-sponsored activities.
