Indiana requests waiver of key provisions of No Child Left Behind

The U.S. Department of Education invited each State educational agency (SEA) to request flexibility on behalf of itself, its local educational agencies, and schools, in order to better focus on improving student learning and increasing the quality of instruction. This voluntary opportunity provides educators and State and local leaders with flexibility regarding specific requirements of the No Child Left Behind Act of 2001 (NCLB) in exchange for rigorous and comprehensive State-developed plans designed to improve educational outcomes for all students, close achievement gaps, increase equity, and improve the quality of instruction. Eleven states have formally submitted requests to the Department of Education for waivers of key provisions of No Child Left Behind (Elementary and Secondary Education Act) under the Administration's "ESEA flexibility" plan. The waiver requests must be peer-reviewed by a panel of experts, and the first round of the review process begins in December. A list of the peer reviewers and the waiver requests submitted by the first eleven states (CO, FL, GA, IN, KY, MA, MN, NJ, NM, OK, TN) can be found at http://www.ed.gov/esea/
The Advocacy Institute and NDSS have created a guide to assist parents in reviewing a state’s waiver request. We encourage families of children with special health care needs/disabilities to become familiar with how this waiver could impact NCLB in Indiana.
