Bills Going into Effect July 1

From The Arc of Indiana

Below are bills important to The Arc of Indiana, have been signed into law and go into effect today:

  • House Enrolled Act 1002- Prohibits FSSA from entering into risk based managed care until January 31, 2023. 
  • House Enrolled Act 1073- Allows for accessible vehicles to be covered under the state's motor vehicle protection act (lemon law).
  • House Enrolled Act 1075- Requires the 1102 Task Force to come up with recommendations for the Direct Support Professional (DSP) workforce, Community Integration and Habilitation (CIH) Waiver application process, and incident reporting requirements. 
  • House Enrolled Act 1169- Establishes the make up of the Division of Disability and Rehabilitative Services (DDRS) Advisory Council and the responsibilities of the council. 
  • House Enrolled Act 1222- Eliminates the Bureau of Quality Improvement Services (BQIS) and reassigns those duties to the Bureau of Developmental Disabilities Services (BDDS).
  • Senate Enrolled Act 284- Adds case managers, occupational therapists, developmental therapists and ABA therapists to the list of telehealth providers. 
  • House Enrolled Act 1303- Provides a tax credit of up to $500 for contributions made to an ABLE Account starting in July 2023. 
  • Senate Enrolled Act 356- Allows for a professional in the disability field that is at least 26-years-old to go through the American Board program and take the required state tests to become a special education teacher. 
  • House Enrolled Act 1192- Defines and clarifies school services that are covered under Medicaid.
  • Senate Enrolled Act 123- Provides consistency for Dyslexia screening in schools. 
  • House Enrolled Act 1112- Allows for Emergency Medical Services (EMS) to be reimbursed at a Medicare rate for all Medicaid clients. 

The two bills vetoed by the governor are House Bill 1211 regarding broadband and House Bill 1041 the transgender athlete bill. The House and Senate overrode the governor's veto on House Bill 1041.
