FSSA reiterates the H&W, PathWays and TBI Medicaid waiver invitation process

Individuals have 180 days from the date of their invitation notice to complete all required steps to become active on the Health and Wellness, TBI, or Pathways waiver.  After receiving an invitation letter, invitees have 45 days from the date on the letter to notify their local Area Agency on Aging or managed care entity (MCE)(a MCE is for Pathways only) of their decision to accept the waiver invitation. After acceptance, invitees must complete these additional required steps within 180 days from the date of the invitation:

  • Complete and obtain Medicaid financial eligibility.
  • Schedule, complete and meet functional eligibility through a nursing facility level-of-care (NFLOC) assessment through Maximus or (for active PathWays waiver members) the MCE.
  • Work with their assigned case manager or the MCE to complete the service plan.

Individuals must accept the invitation within 45 days of the invitation date. If the invitation is not accepted within 45 days of the date of invitation, the invitation will be rescinded, and the individual will not be placed back on the waiting list.

In instances where the process has not been completed within 180 days, the invitation will be rescinded, and the individual will not be placed back on the waiting list. 

Rescinded invitations cannot be appealed. However, individuals may reapply for waiver services at any time.
