Waiver Amendments and Public Comment

The Bureau of Disabilities Services announced a public comment period for proposed amendments to the Family Supports Waiver (FSW), Community Integration and Habilitation Waiver (CIH), Health and Wellness Waiver (H&W), and the Traumatic Brain Injury Waiver (TBI). Public comment is an opportunity to share thoughts and concerns around the proposed changes. A joint statement from the Indiana Disability Alliance The disability rights movement has always been rooted in a simple belief: people with disabilities belong in their communities. For decades, people with disabilities were unnecessarily separated from family, friends, schools, workplaces, and neighborhoods because institutional settings were often viewed as the default option for support. Families and advocates worked tirelessly to change that reality, fighting for the right to live, learn, work, and thrive in the communities they call home. One of the most significant victories in that fight came in 1999 with the U.S. Supreme Court’s landmark decision in Olmstead v. L.C. The Court recognized that unnecessarily institutionalizing people with disabilities constitutes discrimination under the Americans with Disabilities Act (ADA). BDS establishes transition process from Supervised Group Living settings to CIH Waiver

Individuals who currently live in a Supervised Group Living (SGL) setting who wish to transition to the Community Integration and Habilitation (CIH) Waiver will now have to live in the SGL setting for a minimum of 365 days before being able to apply for the CIH Waiver.
